Publisher Terms & Conditions

These Terms of Service ("Agreement") govern the relationship between FLGStore.com ("FLGStore") and the publishers ("Seller" or "Sellers") who wish to sell their products on the FLGStore.com marketplace platform. By using FLGStore.com as a Seller, you agree to be bound by these terms and conditions. Please read them carefully before using our platform.

Registration and Account

1.1 Seller Account: In order to sell products on FLGStore.com, Sellers must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update it promptly if there are any changes.

1.2 Account Security: You are responsible for maintaining the security and confidentiality of your account credentials, including your username and password. You agree not to share your account information with any third parties. You are solely responsible for any activity that occurs under your account.

Product Listings and Sales

2.1 Product Information: Sellers are responsible for providing accurate and up-to-date product listings, including descriptions, pricing, availability, and other relevant information. FLGStore reserves the right to remove or modify any listings that violate our policies or guidelines.

2.2 Sales and Commission: Sellers agree to pay FLGStore a commission fee equal to 5% of the total sale price for each product sold through the FLGStore.com platform. The commission fee is calculated based on the final price of the product, excluding any taxes, shipping fees, or additional charges.

2.3 Processing Fee: Sellers agree to pay FLGStore a processing fee equal to 2.5% of the total sale price for each transaction. The processing fee covers the costs associated with payment processing and other transaction-related services.

2.4 Payment and Payouts: FLGStore will collect payments from retailers on behalf of Sellers for each completed sale. Payouts to Sellers, minus the commission fee and processing fee, will be made at the end of each month. The specific payout schedule may be subject to change, but Sellers will be notified in advance of any modifications.

Order Fulfillment and Shipping

3.1 Order Fulfillment: Sellers are responsible for fulfilling orders promptly and accurately. Sellers agree to provide high-quality products that meet the description provided in the product listing.

3.2 Shipping and Delivery: Sellers are responsible for shipping the products to the retailers in a timely manner. Sellers must provide accurate shipping information and ensure that the products are appropriately packaged for safe delivery.

3.3 Returns and Refunds: Sellers agree to handle returns and refunds in accordance with FLGStore's return policy or as otherwise agreed upon between the Seller and the retailer. Sellers will be responsible for any refund or replacement costs associated with their products.

Intellectual Property

4.1 Seller Ownership: Sellers retain all rights to their intellectual property, including copyrights and trademarks, associated with their products. FLGStore respects these rights and will not use or reproduce Seller intellectual property without proper authorization.

4.2 FLGStore Ownership: FLGStore.com is owned and operated by OOMM Games LTD ("OOMM Games"). OOMM Games retains all rights to the FLGStore.com platform, including its trademarks, logos, and content. Sellers may not use FLGStore's intellectual property without prior written permission from OOMM Games.

Obligations and Prohibited Activities

5.1 Seller Obligations: As a Seller on FLGStore.com, you agree to: a) Comply with all applicable laws, regulations, and industry standards. b) Provide accurate information about your products and adhere to ethical business practices. c) Honor your obligations and fulfill orders promptly and accurately. d) Maintain appropriate communication and professionalism with FLGStore and retailers.

5.2 Prohibited Activities: Sellers are strictly prohibited from: a) Violating any laws or infringing on any intellectual property rights. b) Engaging in fraudulent, deceptive, or illegal activities. c) Interfering with the functionality or security of FLGStore.com or other users' accounts. d) Selling or promoting counterfeit or unauthorized products.

Termination

6.1 Termination by FLGStore: FLGStore reserves the right to suspend or terminate a Seller's access to the platform at any time for any reason, including but not limited to violation of these Terms of Service or fraudulent activity.

6.2 Termination by Seller: Sellers may terminate their account by providing written notice to FLGStore.com. Termination does not relieve Sellers of any outstanding obligations or liabilities incurred prior to the termination.

Miscellaneous

7.1 Entire Agreement: These Terms of Service constitute the entire agreement between Sellers and FLGStore.com and supersede any prior agreements or understandings.

7.2 Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of laws principles.

7.3 Severability: If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
